Privacy Policy of Uppening

This Privacy Policy (“Policy”) explains to what extent Uppening Corporation (*) (“Uppening”) collects, uses, protects and otherwise handles information about users of Uppening Service (“Service”). Uppening (“us”, “we”, or “our”) operates (the “Site”) and through Uppening application (“App”) constituting the Service. This page informs you of our policies regarding the collection, use and disclosure of Personal Information we receive from users of the Site and App.

We use your Personal Information for giving you the Service you wanted and for providing and improving the Site and App. We also collect data for direct marketing, location services and social networking. By using the Site or by downloading the App, you agree to the collection and use of Information in accordance with this Policy. The Policy is part of Terms of Service for users of the Site and App which constitutes a legally binding agreement between the users and Uppening.


1. Information and Data Collection and Use

We use and collect Information and data to operate, maintain and provide you the features and functionality of the Service, to analyze how the Service is used, diagnose Service or technical problems, maintain security, personalize content, remember information to efficently access your account, monitor aggregate metrics, track content, location services, for marketing and social networking reasons to comply with applicable laws.

While using Site or App, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you such as your account information (name or email address, billing and shipping information etc) (“Personal Information”), we may also use other types of Information, suh as Non-Personal Information or Potentially Personal Information, defined below. We collect and may use Information about you when you register, make a purchase, sign up for our newsletter, respond to a survey or marketing comunication, when you enter information on our Site or use certain other Site features in the following ways:

  • To personalize user’s experience and to allow us to deliver the type of content and product offerings in which you are most interested
  • To improve our Site in order to better serve you
  • To allow us to better service you in responding to your customer service requests
  • To administer a contest, promotion, survey or other site feature

1.1 Account Information

Before you are able to use Uppening, you will be required to register for an account with the Service, including by connecting with the Service via third-party service, or by “following”, “becoming a fan” etc., adding the App, etc, on a third-party website or network (“Registration”). To register for account the Service will require the following Personal Information and Potentially Personal Information from you: your name, address, email address, billing and shipping information, credit card information and password. Your email address is transferred to Uppening using encryption called SSL. Your email address is used by us to provide you the Services, including such as allowing us to help you recover your account if you lose your password. Your password is transferred to Uppening using SSL encryption but is only retained in an encrypted format (which means that it is not practically feasible to recover the password from this format). Once you have registered, your password is used to help prevent unauthorized access to your account. Your name, email address and other information you choose to provide on the Service will be viewable and discoverable by other users, in accordance with your settings on the Service.

1.2 Data Used to Provide the Services

Uppening receives and uses the following information for the purpose of providing and improving the Service: IP address, email, date and time of accessing the Service, and various operational data such as the type of client OS and browser version (which are also known as the user agent string).

We also have access and use:

  • Location data: to help user navigate, connect with contacts, serve content relevant to your location, for geo-tagging content (e.g photos) or to make targeted offers/serve relevant ads;
  • Social networking data: Uppening is a social network, which means that it may share the following with other members of the network:
  • location
  • photos/videos
  • likes
  • contacts

User device may allow to control whether App accesses certain data or not (e.g location data). User can visit device settings screen/s for more information. By not agreeing to share location User can control what to share and with who.

1.3 Communications

We or third parties may use your contact information and other information you choose to provide the Service to contact you (including via email or message within App) to send you Service-related notices, also for direct marketing or advertising purposes to send you newsletters, marketing or promotional materials and other material information with invitation to purchase goods or services (“Offerings”). These Offerings will be directly associated with your preferences in the App, no spam or junk mail will be sent.

We use your email address in the following ways:

  • Collect you email address in order to send information, respond to inquiries, and/or other requests or questions or to send direct ads regarding your preferences in the App or subscribtions
  • Do not use false, or misleading subjects or email addresses
  • Honor opt-out/unsubscribe requests quickly
  • Allow users to unsubscribe by using the link at the bottom of each email

We may but are not obligated to ask for your consent when sending messages as users express consent to delivery of digital content by Registration. You can manually opt out of our direct marketing by following the instructions or details in the message or App by changing notification settings. If you correspond with us by email, we may retain the content of your email messages, your email address and our responses.

Our App may include adverts. We provide our partners with some information about the way you use our App so they can advertise products and services that are more likely to be relevant to you.  Ad networks are companies that manage the advertising process on this and many other apps. For that reason, they may know information about you based on the way you use all the apps where they provide advertising services. They compile this information to paint a picture of which types of adverts you are likely to be interested in.


2. Operational Data

Like many site operators, we collect information that your browser sends whenever you visit our Site (“Log Data”) which may include information such as your computer’s Internet Protocol (“IP”) address, browser type, browser version, the pages of our Site that you visit, the time and date of your visit, the time spent on those pages and other statistics. In addition, we may use third party services such as Google Analytics that collect, monitor and analyze this. We collect Operational Data to help users so that we can ensure that we have sufficient capacity to meet user needs and otherwise to help with the operations of the Services.


3. Cookies

Cookies are files with small amount of data, which may include an anonymous unique identifier. Cookies are sent to your browser from a web site and stored on your computer’s hard drive. Like many sites, we use “cookies” to collect information. For instance, we use cookies to help us remember and process the items in your shopping cart. They are also used to help us understand your preferences based on previous or current site activity, which enables us to provide you with improved services. We also use cookies to help us compile aggregate data about site traffic and site interaction so that we can offer better site experiences and tools in the future.

4. Google

Google’s advertising requirements can be summed up by Google’s Advertising Principles. They are put in place to provide a positive experience for users. We use Google AdSense Advertising on our website.

Google, as a third party vendor, uses cookies to serve ads on our site. Google’s use of the DART cookie enables it to serve ads to our users based on their visit to our site and other sites on the Internet. Users may opt out of the use of the DART cookie by visiting the Google ad and content network privacy policy. We along with third-party vendors, such as Google use first-party cookies (such as the Google Analytics cookies) and third-party cookies (such as the DoubleClick cookie) or other third-party identifiers together to compile data regarding user interactions with ad impressions, and other ad service functions as they relate to our website.

Opting out: Users can set preferences for how Google advertises to you using the Google Ad Settings page. Alternatively, you can opt out by visiting the Network Advertising initiative opt out page or permanently using the Google Analytics Opt Out Browser add on.


5. Links to Other Sites and Content Provided by Third Parties

Our web site may link to other web sites outside our control or ownership, e.g. we may include or offer third party products or services on our website. We are not liable for the content and activities of these sites, we advise users to read the Privacy Policies of each web site they visit.

Uppening does not modertae the content or links provided by third parties before their publication on Uppening Site or App. Uppening is not responsible for the content provided by third parties or for its availability. Users may use third-party services or content included in Uppening, but they must be aware of these third parties’ terms and conditions and have given consent to them. Under no circumstances will Uppening be deemed liable in relation to the proper functionality or availability, or both, of third-party services. Nonetheless, we seek to protect the integrity of our site and welcome any feedback about these sites.


6. Disclosure of Data

6.1 Disclosure to Third Parties

We work with third parties who provide services and content delivery networks and other services of an administrative nature. We may share information about you with such third parties for the purpose of enabling these third parties to provide such services mainly including website hosting partners and other parties who assist us in operating our Site and App, conducting our business, or servicing you, so long as those parties agree to keep this information confidential.

However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses. We will not otherwise knowingly disclose Personal Information to other third parties, except when required to do so, such as in order to comply with any law, regulation, or valid legal process, such as a search warrant, subpoena, statute, court order, or if necessary or appropriate to address an unlawful or harmful activity, enforce our site policies, or protect ours or others’ rights, property, or safety.

Additionally, Uppening may need to transfer Personal Information to an affiliate or successor in the event of a change of our corporate structure or status, such as in the event of a restructuring, sale, or bankruptcy.


7. Security

We do not use vulnerability scanning and/or scanning to PCI standards. We use regular Malware Scanning.  Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the information confidential. In addition, all sensitive/credit information you supply is encrypted via Secure Socket Layer (SSL) technology. We implement a variety of security measures when a user enters, submits, or accesses their information to maintain the safety of your personal information.

The security of your Personal Information is important to us, but remember that no method of transmission over the Internet, or method of electronic storage, is 100% secure. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security. Users are responsible for keeping their login credentials confidential. Uppening allows you to access, amend and/or delete your data. Users are able to change their personal information by logging in to their account.

Uppening shall not be held responsible under any circumstances in case of loss, disclosure, theft or unauthorized use by third parties, for whatever reason, of the User’s access credentials.


8. Changes To This Privacy Policy

This Policy is effective as of 30 March 2016 and will remain in effect except with respect to any changes in its provisions in the future, which will be in effect immediately after being posted on Site or added in the App. Each time you use the Service the current version of this Policy will apply. We reserve the right to update or change our Policy at any time and you should check this Policy periodically. Your continued use of the Service after we post any modifications to the Policy on the Site or added in the App will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Policy. It is your responsibility to ensure that you understand the terms of this Privacy Policy.

To make your review more convenient, we will post an effective date at the top of Policy updated on the Site or added in the App. Material changes will also be announced through the standard mechanisms through which Uppening communicates with the users.

“Information” – Personal Information, Non-Personal Information and/or Potentially Personal information

“Personal Information” – is information that you provide to Uppening that personally identifies you and can be directly associated with you as an individual in context such as your name, phone number, or email address, home address, billing and shipping information and credit card information

“Non-Personal Information” – is information that cannot by itself be directly associated with a specific person or entity. Non-Personal Information includes but is not limited to your computer’s configuration and which web browser you use

“Potentially Personal Information” – is information that is Non-Personal Information in and of itself but that could be used in conjunction with other information to personally identify you. For example, Uniform Resource Locators (“URLs”) (the addresses of web pages) and Internet Protocol (“IP”) addresses (the addresses of computers on the internet) can be Personal Information when combined with internet service provider (“ISP”) records

“Operational Data” – means data regarding a user’s usage of the Services, such as access log data (such as data about when people access the service and with what piece of software)

“Usage Statistics” – refers to the Non-Personal Information Upper will use to understand your use of the Service. Such information may include but is not limited to the amount of data you are storing with the service, the frequency with which you access the service, user interaction data, and traffic shaping

“User” – The natural or legal person who makes use of the Service provided by Uppening

“Registration” – inserting all required Personal or Potentially Personal information by the user on the Site or App, which indicates users express consent to delivery of digital content and agreement with the terms of privacy policy and terms of Service and including by connecting with the Service via third-party service, or by “following”, “becoming a fan” etc., adding the App, etc, on a third-party website or network

“Service” – services provided by Uppening on the Site or by the App and which constitutes of devilery and usage of such digital content which is not delivered on a tangible medium and which delivery has begun with the usage or upon registration of users on the Site and/or App that indicates users prior express consent to delivery of such medium. The Service is provided by Uppening “as is”, with no express or implied warranty for accuracy or availability.
